Rental Terms and Conditions

1. Reservations and Payment Schedule
- Booking Confirmation: Submitting a reservation request does not guarantee availability. A booking is confirmed only when Game Party Pros accepts it and the 50% reservation payment is paid.
- Balance Payment: We do not automatically charge your card for the final balance. Instead, a secure payment link for the remaining 50% will be sent to you 48 hours prior to your event. Full payment of this balance must be received no later than 24 hours prior to the event. Failure to pay the balance by this deadline will result in cancellation of your reservation.
- Card on File: Your card is securely saved via Stripe strictly for any applicable damage, excessive cleaning, or replacement charges. Customers may request to have their card removed once the rental is considered “settled” (defined as the close of the 3-day assessment window with all pending damage or late fees fully resolved).
2. Rental Period, Rates, and Taxes
- Timeframe: A standard reservation covers a 48-hour period beginning from the time of customer pickup or successful delivery, unless an extended rental duration is explicitly requested and approved on your reservation.
- Pricing: The base rental price is final for this window and includes all applicable Arizona transaction privilege taxes. Damage, excessive cleaning, and late-return fees outlined in Section 6 are billed separately. Any delivery fees are confirmed prior to payment.
3. What You Are Renting
The specific items and dates are detailed on your reservation. All equipment remains the property of Game Party Pros. No subletting, taking equipment outside the agreed service area, or off-label use is permitted.
4. Delivery, Setup, and Pickup
Customers may choose pickup or delivery at the time of request. An adult (18+) must be present for handover and return.
- Site Requirements: For deliveries, the renter must ensure level ground, adequate gate width, that sprinklers are turned off, and that pets are secured. If equipment requires staking, the renter is responsible for confirming there are no buried utility lines in the setup area.
- Failed Deliveries: If Game Party Pros cannot deliver because no one is present or the space is inaccessible, the handover is forfeited. The full rental total is retained, and any requested redelivery will require a separate fee.
- Transit and Loading Liability: For customer pickups, the customer is solely responsible for securing, tying down, and inspecting the load in their vehicle, regardless of whether Game Party Pros staff assists with lifting. Game Party Pros assumes no liability for accidents, injuries, or vehicle/property damage caused by unsecured or improperly loaded equipment during transit.
- Delivery Liability: Game Party Pros is not liable for inherent risks associated with residential deliveries, including but not limited to turf compression, driveway impacts from heavy equipment weight, or maneuvering through tight gates.
5. Your Responsibility for the Equipment
The renter is responsible for the equipment from the time it is picked up or delivered until it is returned or collected. Equipment must be kept secured and supervised.
- Cleaning Expectations: Equipment must be returned in the general condition it was received. The renter is responsible for wiping down tables and chairs to remove food spills, sticky residue, or loose debris, and brushing heavy mud or dirt off lawn games.
- Prohibited Actions: Do not attempt repairs or modifications. The use of staples, nails, tacks, or strong adhesives (such as duct tape) on tables and chairs is strictly prohibited.
- Moisture and Weather: Renters must make a reasonable effort to cover or move equipment during rain; however, incidental moisture is classified as normal wear.
6. Damage, Loss, and Late Returns
Normal wear from ordinary use — such as minor scuffs, light dust, grass stains, or incidental moisture — is expected and is never charged for.
- Damage and Excessive Dirt: If an item is returned damaged beyond normal wear, with excessive dirt, or sticky residue requiring heavy cleaning, you authorize Game Party Pros to charge the card on file for the documented cost of repair, excessive cleaning, or replacement.
- Replacement Caps: Charges are capped at the item’s replacement value, which is fixed when you book and does not change afterwards. The itemized replacement-value list for your reservation is available any time on request.
- Theft and Loss: Stolen or missing equipment must be accompanied by a formal police report provided by the renter to process claims and avoid automatic replacement charges.
- Late Returns: Equipment not returned or made available for retrieval by the end of your agreed-upon reservation window will incur a late fee equal to 50% of the base rental total (excluding any delivery fee) for each additional 24-hour period or portion thereof. Late fees are invoiced separately and are not automatically charged to the card on file.
- Non-Return: If equipment is not returned or made available within 24 hours after the close of your agreed-upon reservation window, Game Party Pros will send a written non-return notice to the email on file identifying the missing items and their replacement value. The renter has 48 hours from the time that notice is sent to return the equipment or dispute the claim by email. If the equipment is not returned and no dispute is raised within that period, the card on file will be charged the replacement value. Late fees accrued through that date remain payable and will be invoiced separately. Late fees stop accruing once the replacement charge is made.
- Return After a Replacement Charge: If equipment is returned in serviceable condition within 14 days of a replacement charge, Game Party Pros will refund the replacement value less all accrued late fees and any repair or excessive cleaning costs assessed under this section. Equipment returned after 14 days, or returned in unserviceable condition, is not eligible for refund.
7. Damage Assessment and Chargeback Policy
We assess returned equipment within 3 business days and will send photographs of any damage along with repair/replacement costs via email prior to charging your card.
- Dispute Window: The renter has a 48-hour review period after receiving this notice to dispute the assessment via email before the securely saved card is billed.
- Chargebacks: Renters agree to utilize this internal email dispute process before initiating a bank chargeback. Initiating a chargeback prior to completing this dispute process constitutes a breach of contract. This dispute process applies to non-return claims under Section 6 as well as damage and cleaning assessments.
8. Cancellations and Refunds
- More than 3 days prior to the rental date: 100% refund of the reservation payment for any reason.
- Within 3 days of the rental date: The 50% reservation payment is non-refundable, as equipment has been held and other bookings turned away.
- Missed Payment Deadline: If the final balance is not paid via the provided link at least 24 hours prior to the event, the reservation will be canceled and the 50% reservation payment is forfeited.
- Cancellations After Balance is Paid: If the final balance has already been paid and the rental is subsequently canceled prior to the event, the final balance will be refunded in full, but the 50% reservation payment remains non-refundable.
- Game Party Pros Initiated Cancellations: If Game Party Pros initiates a cancellation, a full refund of all amounts paid is issued immediately, bypassing the 3-day rule.
9. Weather Policy
Game Party Pros reserves the right to determine if forecasted weather renders equipment use unsafe. If weather forces a cancellation, bookings can be rescheduled to another available date at no charge. One free weather reschedule is permitted per booking; subsequent changes fall under the standard cancellation policy. If no reschedule date works, a full refund will be issued.
10. Safety, Supervision, and Liability
Equipment must be used as intended, supervised by a responsible adult, and not used while impaired. The renter acknowledges that participating in yard games and utilizing event equipment carries inherent risks, and voluntarily assumes full responsibility for the safety of all guests and users.
- Indemnification: The renter agrees to indemnify, defend, and holdGame Party Pros harmless from any and all third-party claims, damages, losses, or legal fees arising out of the use, possession, or transport of the rental equipment, except for claims arising directly from Game Party Pros’ own negligence or an inherent equipment defect as supplied.
- Limitation of Liability: To the maximum extent permitted by Arizona law, the total liability of Game Party Pros for any claim arising out of or relating to this agreement or the rental equipment shall not exceed the total amount paid by the renter for the applicable reservation. Game Party Pros shall not be liable for indirect, incidental, consequential, or special damages, including lost profits, lost deposits paid to third parties, event cancellation costs, or loss of enjoyment, even if advised of the possibility of such damages. This limitation does not apply to claims arising from gross negligence or willful misconduct.
11. Force Majeure
Game Party Pros shall not be held liable for failure to deliver or perform its obligations due to circumstances beyond its reasonable control, including but not limited to severe weather, road closures, civil emergencies, or accidents. In such events, the maximum liability of Game Party Pros is a full refund of all amounts paid.
12. Severability
If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
13. Governing Law
These terms are governed by the laws of the State of Arizona. Any legal action or proceeding related to these terms shall be brought exclusively in the courts located in Maricopa County, Arizona.
